Ohio Court Strikes Down Pit Bull Ban

Happy Pit BullSam over at Pooch Master writes about an Ohio State Appeals Court striking down a city ordinance in Toledo that limited residents to one vicious dog, or one pit bull.

In general...
"Since we conclude that there is no evidence that pit bulls are inherently dangerous or vicious, then the city ordinance limitation on ownership is also arbitrary, unreasonable, and discriminatory," Judge Skow wrote."

  • I am a veterinary technician and have been for 11 years. I also own a 8 year old pitt bull, he is around small children and other small animals and has never shown any aggression towards them, he is actually afraid of the cat who chases him and shakes when my sisters shitzu bites at his feet, it is all in how you raise them, his mother and father were put down for aggression, show it even showes it does not run in the blood line.

  • Pit Bull dogs are inherintly more dangerous simply because of the way they bite. This is not debatable. That is what so many pit bull owners like about their dog. To say that a dog, who was bred for characteristics that will make a better fighter, is not likely to be more aggressive than another dog is like saying that a sheltie is no more likely to herd than any other dog. Hope its Judge Skow's leg that gets "locked " on to and not mine.

  • Please get an education.I am sick of explaining pitbulls to people. Its amazing now we humans don't try to think.If pitbulls was that vicious, than why haven't I been biten.My neighbors haven't.I know of literally hundreds of ones that haven't bit anyone.
    There are sites out to educate you about them. It's your own fault you don't know about them. So don't whine to the knowledable people about it.

  • Actually, the way a "pit bull" bites is no different than the way any other dog can bite. They just have stronger muscles around the jaw area, just like all types of mastiffs. So why haven't we banned mastiffs? They are, as you said Mr. Anon, dangerous because of their jaw structure.

    No animal can inherit "viciousness." Think about humans, do all children of abusers/murderers/rapists end up like their father/mother? No. It's no different in animals. I would like to see proof that this is the case because it certainly hasn't been for thousands of years.

  • Please, all apbt, staffie, bull terrier/bully dogs owners/lovers/advocates...pls remember the name American Canine Foundation. ACF is the advocacy group that funded the Tellings v. Ohio trial, and it was their hired attorney Sol who did the trial. ACF is in CO working on the law, in WA working on the law, in CA working against SB861 (counties can name breeds under dog statute,then mandate altering. problem is by doing so, it confers status on breed of dangerous dog, sort of the opposite of most BSL--but that's definitely what it is) Please consider helping/funding ACF, which has currently enabled the dog advocates to use the precedential published decision out of Ohio. Even if appealed it is my opinion that the case is so strong, it will withstand challenge. If the Supreme court in Ohio were to overturn it, I think there would be judidical misconduct because the ruling is EXCEPTIONALLY CLEAR ON ALL BASES.

  • yesssss... i am being harassed by the dog warden and my neighbor ... whendoes it become harassement from them...in order for them to stop being the vicious animals that they are being ....its sad ...we took 2 puppies from a abusive situation and they still cant be left alone....i need some imput as to when does it become a crime for the abuse they are trying to bring into my home...

  • why cant uneducated people see that APBT's are like every other dog breed, just that they are powerful dogs. I own a wonderful American Pit Bull Terrier and she is my baby! This dog loves people no matter who it is child to senior citizens. She would never hurt ANYONE!Chloe is a ambassador to her breed.
    If people could just see for themselves and see what great dogs they REALLY are then I truely think that they wouldnt had suck a fit!

  • I have a case that i am taking to the court of Appeals right now fighting for my pitt bulls rights.they have tryed to kill him 3 times and i have stoped it.My case in out of Lancaster,Ohio in Fairfield County.

  • I own a pitt bull and she has NEVER been aggressive towards kids or my other dog which is a mastiff in fact... my newphew even bit her toung (the pitt bull) and she just sat there Sage would never hurt anyone the police that patrol the neighborhood even stop to see her and bring her doggie treats... She is the biggest baby i would be lost without her! She is just like on of the kids.

  • Some people think that pitbulls are vicous and dangerous no matter what! Pitt bulls are dangerous when they get a hold of you. I have a pitt bull and boxer mix she is the sweetest thing. thats why you see pittbulls more than any other breed of dog in the shelter because people dont trust them. Pitt bulls and rottweilers get a bad reputation from the way they can attack you with their strong muscles. My piont is that no dog is mean unless it is trained to be. No one wants to come to my house because i have a pittbull boxer mix and a purebred rottweiler. Thats being just mean to the dogs!! thats what i have to say !!

  • i have a pittbull mix and she has never been aggresive. i also have a rottweiler and he is teh sweetest thing. pitts and rottweilers get a bad rep because of their strong muscles. i Ma a dog lover i've always been. some people think that all pitts and rottweilers are mean all i have to say is no dog is mean unless they are tranied to be !!!!!

  • I currently live in Toledo, Ohio and I own a pittbull. I have had her since she was 5 weeks old, and she is the sweetest dog ever. I think it is some BS that the Dog warden, Tom Skeldon, is decriminating against one breed of dog. I dont understand why it is ok to own 2 rottweiliers or two boxers, but not more than one pittbull??? It angers me. The sad thing is that they want you to muzzle them?? NEVER! My pittbull will NOT wear a Muzzle, and if Mr. Skeldon comes to my door, He will have to fight me for my dog. He is a Vicious Dog killer! Hopefully the supreme court will rule the right way, and not his way. Pittbulls have rights too. I want to fight for there rights. If anyone is with me, E-mail me at pittbullam7373@yahoo.com. We need to stand up for all the innocent pittbulls that havent done anything to anyone. Besides, I thought it was Innocent until proven Guilty????

  • I have just one thing to say about the people that think pittbulls bite different than any other dog. Its not the truth. They bite the same as any other dog, and NO they DO NOT have Lock Jaw. Pittbulls are the same as any other breed of Terrier, Insistant.Honestly, If you want to know the truth, I got bit by a cocker Spaniel, and that dog was vicious, but the funny thing is, I have has my pitt for 3 years, and she has NEVER bit me or anyone for that factor. If u show a dog that u are scared of it, chances are, u may get bit. They can sense fear. As far as im concerned, people need to just keep their noses in their own homes and yards and so on.... If the Pittbull hasnt messed w/ u, than leave it alone. Pittbulls are good family dogs, and i would own no other breed, part of the reason i got a Pitt in the first place, is to prove people wrong about them, and the funny thing is, I have. Its all in how u raise them and NOT in how they are inheritly. Stupid people fight them, not true dog lovers. Tom Skeldon and the Toledo Police need to start focusing on the Crime in Toledo, and stop wasteing their time w/ Animals that deserve to live just as anyone else does. And why do we not hear about the other breeds of dogs that bite people??? It happens EVERYDAY, NOT JUST PITTBULLS!!!!! I also have a mini Daschund, and She bites people, does that mean she is vicious? Probably not, because she is a little dog, and no one thinks they can hurt u, but trust me, from expierience, she has broken my skin, and drew blood. So people, before u start pointing the finger, and upsetting people when their INNOCENT pitts didnt do anything to anyone, Take a look around at your dogs that u think wont hurt anyone cause "their not pittbulls", and realize that ANY dog could bite someone. As far as im concerned, If this ruling gets passed, they should do away with ALL DOGS to make it fair. Open up your eyes people, and have a heart, Dont be Killers along with Tom Skeldon, and if the Pittbull hasnt bothered u, than Leave it and its owners alone. U know, its like descriminating against Blacks and Whites, and thats not legal, so this shouldnt be either. Fight for the Pittbulls rights!

  • Yay for Toledo, however in Fairfield County there there are laws that still exsists. Not only pitbulls, but also great danes and bulldogs as well. I'm trying to find more about the law, but as of now I haven't found much. If anyone can help me my e-mail address is Athenaml@columbus.rr.com.

  • PitBulls have a different bite they crush do to the strength of the bite.(2,000 Lb force) In the state of ohio the law states only 1 pittbull per family you must carry 100,000$ insurance the dog must be on a leash when outside, and if kept outside in a kennel with top and bottom. This is what I found researching, I do agree it's how the people treat the animal it's not the dogs fault.

  • I live in Cincinnati Oh there are still pit bull laws in place. When I was 19 years old I hab a 6 month old pit bull puppy that tunneled his way out of my back yard. He was napping on my porch when SPCA drove by and decided to pick him up. The man that picked him up told me how sweet he was, he he had to hold him at the SPCA till I went to court for my vicious dog. I had proper insurance, tattooing and micro chipping. He had never shown any vicious tendancies. I went to court three times the because the wanted to put him down and I was deturmined that was not going to happen. The last time I convinced the judge to allow me to bring him with me. As I was pleading with the judge to allow my dog that I love to live he broke free of my grasp and run up to the judge and sat on his lap to give him a kiss. The judge never signed the paper to have him put down. I was able to pick him up after 11 months of fighting and take him home. It cost me and my family over 7,000 between lawyer fees and court costs. When I got him out of the SPCA he was as loving as ever. He left the SPCA with mange and several other conditions that cost me more money. I would do it all again in a heart beat!!! I love my dogs and they are the sweetest dogs you would ever see. I am so glad that some people are starting to realize that that they should hate the dead not the bread. I love the loyalty, obedience, and temperament of my pit bull much more so than any of the other dogs i have. He is an amazing dog.

  • Shame on big brother sticking his nose into our lives once again. It is no more legal to discriminate against a breed of dog than it is to discriminate against people. Humans and there supiority complex! I have a pit bull lab mix. He was an abused stray. My vet has said to never tell anyone he has pit bull terrier in him.I went thru the same ridicule when I owned a german shepherd(she passed in feb) If you don't like my dog stay away.Crack down on the irrisponsible pet owner, like the one who abused my dog and leave the people doing the right thing alone.

  • I've been looking over the comments on this page and found several references to Fairfield County, OH. We are residents there and are having a problem of our own. My son's pitt/boxer mix was picked up after breaking free of his kennel; he went to the school and tried to play with the kids. Didn't hurt anyone; but school called Dog Warden and he was picked up. After 2 days of searching, we found him at the Warden's. They had not fed him at all and he was traumatized. My son has received 3 different citations totaling over $300.00 and must appear in court. (Guess what! This is a Misdemeanor 1 and will appear on his record for life!!!) He could get $1000.00 in fines and have to serve 6 months in jail. If we were talking about a poodle, we wouldn't be in court. I thought discrimination was illegal in this country. Guess it isn't in Fairfield County OHIO. Anybody wanna buy some property? Anyone got any ideas?

  • I'm a humane officer in Ohio and I was shocked to read this: **Kansas City, Mo: The City Council passed a law last month that will require all pit bulls to be spayed or neutered. Breeders will have to install fencing and document who buys the puppies, says Councilman Bill Skaggs, who supported the measure.** We need this! Ohio needs to ban bad behavior, not pits. At the same time however, I have seen a decrease in dogfighting/breeding because breeders/fighters can't afford to keep pits. Our animal control officers are amazing and ticket like crazy. Do we strike the ban and allow all the naughty people to have pits or punish the nice people and make them pay the price for the few vicious pits?

  • Please do something to the idiots who use these dogs as status symbol and use them to fight. Put the thugs to sleep instead of the pits. They're the problem, not the wonderful American Pit Bull Terrier!!! I've had more problems out of Chow-Chow's, but I don't see ignorate people trying to ban them. Oh no.....just the Pit Bulls'.

  • 5/30/3008 Well we're at it again. Some Ohio cities want the poor Staffordshire Terrier banned totally and put down. I had 2 so called pittbulls. They are the most loving and gentle dogs I ever had. It is the people that fight them and have destroyed this breed by their stupidity that has hurt this breed. That is were the name pitt bull came into play because idiots took them into a pit arena and fought them.It is the person that fights this poor animal that should be picked up and put down. We must do something for this bred before it is too late

  • I have had my Pitt Bull since he was 3weeks old, he is the most lovable dog i have ever had in my life! He loves everyone he will lick your face until his tongue falls off. I can tell you he has been the best dog i have ever had!!! And i will fight for his rights until i die if i have too!! People just dont get it!!!! He is like my child to me and no one will ever take him away!! NEVER All you PITT BULL Owners fight for them they have a reason to live just as every other dog DOES!!!   • I'm surprised by the people who say that pits aren't more inclined to fight or be more viscious than other dogs. There is a reason they are called "Pit" bulls! They are bred to fight in a pit. without training, they may not be AS INCLINED to fight, but the instinct--which is part of the breed--remains there. I have had several dogs, most of which are sheparding dogs, and it is stunning how powerful their instinct is, and how different their personality is from Bulldog breeds. To say that there is no difference is just STUPID and willfully blind. It's like saying a donkey is just like a horse. Or a cow is no different than a bull. But YES, more than the breed, it's what the owner DOES with the dog that is important. My border collie is a naturally Alpha dog and can be aggressive, but I've taught her not to be. However, her INSTINCT is to NOT BITE. She would growl and snap, but she's never bitten any animal--they are bred to nip at the heels of animals and that's what they do. I don't think the same can be said of dogs like pit bulls, who are bred to BITE. And guess what? That's what they do--when provoked--or trained to do so without provocation.
    Finally, don't be idiots: to discriminate between breeds of animals does not equate with racial discrimination. Dogs do not have rights in our constitution and God forbid that animal rights extremists ever get to the point they equate human and dog life as equal.

  • A typical arguement...If you think ALL Pit Bulls are inclined to bite or attack people, then you haven't been around Pit Bulls nearly enough. Have you seen the news where dog fighting rings get busted and they go in to remove the dogs? I don't see the dogs visciously attacking the people removing them. Usually they have their tail between there legs and they look scared to death. Generally you see their broken, bloodied little bodies getting shoved into the back of a truck where they are being sent off to be killed. MOST of the dogs they remove were put in a pit with a aggressive dog and left to defend itself...even if they don't want to fight. What a horrible death. What a horrible life. Seriously, laws that put WAY harsher punishments on those who dog fight need to be considered more than banning the breed. Having worked at a vet for 5 years, I have yet to see one that is people aggressive. Sure there are some bad ones in the bunch, but you have that with any and every breed.

    It may not be the same as racial discrimination, but our right to own a domesticated pet IS being infringed upon, even to those who are responsible pet owners. It is a FORM of discrimination in the sense that they are looking at only the NAME of the breed, not the pets as individuals, and saying they are all vicious...then trying to tell responsible owners that they have to kill their dog. That's where the problem is. Just because someone of some racial background may statistically be more inclined to violence doesn't mean everyone of that race is violent. It's the SAME DIFFERENCE! I think its strange that people make a bigger fus about owning Pits than they do exotic animals like Lions, Bears, Tigers, etc. that CLEARLY are not meant to be pets. Explain to me how that makes sense.

  • Has anyone seen The Dog Whisperer??? Cesar has at least 15 pitbulls running freely in his pack. He even uses Daddy, a pitbull owned by rapper Redman, to help train dogs that are dog/people aggressive. I've owned pits for nearly 20 years with no problems at all except for scared neighbors calling police. I have to respect people for protecting themselves. However, people to educate themselves and stop believing everything they hear about the breed to be true. They are gentle dogs most of the time. I think as a owner of the dogs I can be fair and obey the confinement laws that are in place in most states. However, to ban the dogs or tell me I must neuter/spay my top show quality prospects is just flat out ridiculous. I can't show a neutered/spayed dog in an AKC contest, it is immediate disqualification. So now you want me to give up and honest way of living because some knucklehead hoodlum wants to parade his maneater around the Hood???? Give me a break. I think it's messed up that even the dogfighters have these dogs that will fight for them, but they won't even fight for their dogs. We are giving up our rights here in the US one after another. Damn is this Russia in 1950 now?? Police/Government run everything. I can own firearms all day. I could have a thousand pistols and can't own one pitbull. Here in Cincinnati I don't see the police running drug dealers off of these corners. I can buy crack easier than I can find a pitbull puppy.

  • A young girl fell back on my pit bull and his (tooth) meaning one tooth snagged her arm and now we have to got o trial.An ordinance was just passed against pit bulls in my town so i believe we are being used as the examples. Would we be going through this if this had been any other dog. I don't think so. My dog wouldn't hurt a flea he is scared of his own shadow and now he may possibly be put to sleep if we don't win this trial.
